nbc bay area news starts now. >> right now at 11:00, san jose police already out in force to prevent scenes like this ahead of cinco de mayo. i'm jessica aguirre. >> i'm raj mathai. they are cracking down the party begins. sjpd setting the scene tonight in what's traditionally been an unruly party weekend in downtown san jose. they want to take the fight out of cinco de mayo. chase, what's the strategy here and any problems tonight?

>> reporter: raj, so far, so good. but it is still early. and the strategy is essentially strength in numbers. we're told that it is all hands on deck at san jose police this weekend and they're not the only ones. the santa clara sheriff is also getting involved. based on the number of people we've already seen out downtown tonight, that could be a good thing. >> all right by 6:00, 7:00, san jose police gathered ready to hit the streets. we spotted plenty making rounds downtown. a cavalry's worth of motorcycles. even some targeth transit stops and all because thecinco de may on display. >> it's the whole month of may, starting with may day. >> reporter: in the past, celebrations have soured giving way to violence and vandalism like in 2007.

>> for myself, 20 years i've seen the good and the bad. >> reporter: the owner of chachos is glad to see police taking this weekend seriously targeting drunk drivers and generally anyone who gets out of hand. >> i think people are coming downtown with a conscience. obviously, the demographics downtown are changing. the economy is changing. there's residents living down here. you see a big change in the people out here. >> for those same old troublemakers the santa clara sheriff has its gang task force out this weekend, too. a source tells nbc bay area certain deputies will be looking for parole or probation violators. the kind of people who may be the source of problems. >> the police are -- they are around, but sometimes you need them to be there. >> the more the merrier. the more the merrier. that -- keeping a constant out there. it does make a big difference. >> reporter: the advice this weekend is the same as it is every party weekend. they say call a cab. plan a designated driver but still people don't do that.

and there are a lot of duis. speaking of, the santa clara sheriff will have several dui saturation patrols in certain areas. mostly along the peninsula. everywhere from cupertino to los altos hills, san jose, santa clara, saratoga, sunnyvale. a lot of police will be out. police and deputies will be out looking for drunk drivers over the next few days. be aware and plan ahead. chase kane, nbc bay area news. american flag clothing warn in 2010 turned into a full legal battle and could be again. students in morgan hill had hoped the controversy was over, but come monday the school district is bracing for another protest and possible violence. a court ruling is igniting the battle over the right to wear an american flag t-shirt on a day that celebrates mexican heritage and pride. >> reporter: the school district

is fighting back against this protest. and they are doing it with this fence. it runs the length of the school. you can't see through it and you can't see over it. it's too tall. that's the whole idea. a patriot group will be here on monday and the students i talked to say they don't want them here. morgan hill residents know about monday's scheduled protest outside live oak high school. but no one wanted to talk about it on camera. but the group organizing it did. >> we feel that it's appropriate to have patriotism 365 days a year. >> reporter: georgine scott is president of the gilroy morgan hill patriots. she says her group will assemble outside the school at 7:30 a.m. on monday. >> what we plan on doing is standing there with our american flags in silence for an hour. just to support our first amendment right to do that. >> reporter: they feel like their first amendment right was silenced by a three-panel judge who said the school district acted properly four years ago

when they told four students to turn their american flag t-shirts inside out or go home. the problem is, they wore them on cinco de mayo and latino students thought the fact they wore the shirts on that day was disrespectful. it created a lot of outrage and student protests. >> why would anyone want to stop us from exercising our freedom of speech? >> you have these people cloaking themselves with the u.s. flag, calling themselves patriots when in fact, they are anything but patriots. >> reporter: juan lopez formed a new group called we the people. he's afraid the patriot protest will spark violence because groups from outside morgan hill say they are planning to come. he also says live oak students don't want anyone in front of their school on monday. >> we actually have choices. her choice is to stand in front of the school. where the children have already told us that at community meetings, including one young lady who cried and plead with her, please move your rally. i have a choice to join her in front of the school or a choice to respect what the children

want. >> reporter: the children have been very vocal about this. now we did try and catch up with the four students who wore the american flag t-shirts four years ago. all of them have graduated. many of them are away at college. now the plis department says they will be beefing up security here on monday and the school superintendent says he will do everything he can to protect the students if necessary. reporting live in morgan hill, i'm cheryl hurd, nbc bay area news. >> thank you, cheryl. it's the end of their college careers at san jose state. the university expelled three white students accused of bullying their black roommate. the university found they violated school rules and placed the victim's safety in jeopardy. a fourth student was suspended until july. all four students are accused of putting a bike lock around their roommate's neck and taunting him because of the color of his skin. a student from wilcox high school has died in a car next north san jose. she was the passenger in a car.

it happened late this afternoon on north first street. the driver of the car, a 17-year-old boy, is in the hospital tonight with life-threatening injuries. he was driving this black sedan that crashed into a traffic signal pole. the impact alone killed the girl. this happened at north first and tasman drive not far from 237. they were reportedly headed to a friend's house. >> he was on the way to her house. we heard what happened and we came down here real fast but they were already taken away. he's in the hospital. he wasn't alert or anything for a while. they said he's talking now. i just talked to his family. >> police say they don't think drugs or alcohol played a role but they do believe the boy may have been speeding and possibly ran a red light. a second car carrying a family of four was also involved in this crash, but none of them were hurt. new at 11:00, he made it to hawaii but so far no reunion for the father of that 15-year-old

son who stowed away in the wheel well of a maui-bound flight. the 15-year-old survived subzero temperatures in a five-hour flight. according to the mercury news, he's still being kept by welfare services and it's not clear why social service officials are not allowing him to see his father. she may have been related to the man who stabbed her to death. san jose police arrested a suspect in the killing of a san jose mom. police arrested gabriel arrejo on wednesday, one day after teresa maria was found dead in her apartment. she was the mother of a newborn baby and twin girls. also san jose's 13th hom saicidf the year. it's been called the largest massage parlor sting. dozens are behind bars. hundreds of law enforcement officers raided massage parlors across the country. prosecutors say they were fronts for prostitution. some people who live near these parlors say it's about time.

>> i think that this is good what they are doing, cracking down on these, you know, shack shops that are up here and pretending to do business and it's not legal. we want it out of our community. >> prosecutors say some of the businesses also contained illegal marijuana grows. two dozen people have been forced out of their homes tonight after a fire in san francisco spread to four houses in the oceanview neighborhood. it happened on bright street. one man risked his life to save several others running back inside the burning homes armed with nothing but a fire extinguisher. and the fire disrupted light rail service for hours as well. three people, including a firefighter, suffered minor injuries. good evening. i'm meteorologist jeff ranieri. major cooling today. half moon bay from 80 on thursday to 57. san jose, 92 to 86 and even colder this weekend. we'll let you know how low we'll go in just a few minutes. hidden in plain sight. a pot bust at a local airport

not exactly the best plan for smuggling 81 pounds of pot. police arresting a woman at the oakland airport after she checked three suitcases filled to the brim with marijuana. tsa agents found it during a routine inspection. nbc bay area's dean elliott live at the airport. she really didn't conceal it all

that well. >> well, jess karks this 26-year-old woman came here to the airport and simply checked three bags full of marijuana for her flight to mississippi. while she sat in boarding, tsa agents smelled something suspicious. every checked bag on the conveyor belt at the oakland airport gets screened for explosives by the tsa. some are opened and searched by hand. this morning, agents opened these bags and found them packed full of pot. the tsa called the alameda county sheriff's department. >> our deputies came across several bags filled with marijuana. we looked further into it. totalled it all up and it was about 81 pounds. >> it was a random search that uncovered three suitcases of vacuum packed bricks of marijuana. the sergeant ray riley says agents probably smelled something suspicious. >> as most people may know, it's not hard to smell the odor of marijuana. it's hard to conceal that odor. >> the alameda county sheriff's

department arrested the 26-year-old woman who checked the bags. the passenger was flying with her 81 pounds of pot to jackson, mississippi, where investigators believe she planned to cash in. >> we in california are known for having high quality marijuana and lots of it. so it's basically being exported out of our state, we believe, to mississippi, where it's probably being sold at a much higher value. >> the stash may be worth $500,000 in mississippi. while the woman is under arrest, the tsa tells us passengers who fly with much smaller amounts of marijuana and a medical marijuana card don't usually go to jail. >> normally if it's an allowable amount of marijuana. but when the police officers respond, they just allow the passenger to go on n travel. >> this time police canceled the trip. >> it's one of the large ear one of the larger drug finds that i recall in my 12 years with the tsa. >> now investigators are hoping

to learn from this woman, who she's working with and if she's taken this kind of business trip before. reporting live at oakland, jean ellie, nbc bay area news. a deadly and mysterious virus from the middle east has hit the news. it was first discovered two years ago in saudi arabia. it originated in camels but then made the jump to humans. about 200 people have died in the middle east from the disease's intense flu-like symptoms. now a man who travelled to saudi recently is in an indiana hospital with mers. because he traveled by plane and then bus to indiana, other passengers are being notified. a vaccine has not yet been developed. more details about this mers virus. it's sorimilar to sars which quickly spread around the world. like the camel connection, with mers, sars is believed to have jumped to humans from small mammals in china. it killed about 800 people.

a legendary and expensive showdown in the second legal battle between apple and samsung. both companies are at fault. that's the verdict that came down today from the jury in california. however, samsung is more at fault. samsung has been ordered to pay nearly $120 million for infringing on apple patent software. apple has been ordered to pay samsung about $158,000 for infringing on samsung technology. this is the second trial between the two big companies. apple won $930 million in damages back in 2012. google glass is getting a night out. that's the idea behind a nationwide event set for tomorrow. it's called a glass night out. and people with the high pic device are encouraged to show up at certain meeting events. google wants to have the event to dispel myths about the device. glass has been banned from several businesses because users can so easily record and take pictures of other people.

critics say the pricey wearable tech is a symbol of the growing class divide. clear the sidewalk or prepare topayñ that's the message to downtown restaurants in palo alto. they received a lot of complaints about the lack of sidewalk space from both locals and visitors. city law states businesses need to have at least eight feet of sidewalk clearance. they are happy to comply if others do as well. >> the hardest thing for us is really when you walk down a lot of you'll see that there are a lot of restaurants not upholding that where we are. >> code enforcement officers are set to check the downtown area soon which may mean fines for some businesses. let's bring in chief meteorologist jeff ranieri. earlier tonight he was at the livermore wine festival. he's back with some bottles of wine for everyone? >> i do have one. it's in the car. i forgot to bring it in. maybe on monday. >> right. uh-huh. yeah, right. >> so kind of the kickoff

tonight at the livermore wine country festival. a lot of people heading towards downtown. it was in the 80s there today but felt like the 90s in the sun. and speaking of which, it has been a hot week. the warmest was wednesday. 98 degrees in cupertino. that was the hottest. think about our average, 74. way above that. but now we are starting to see some major cooling across the bay. anywhere from 4 to about 11 degrees cooler. the primary reason why we're seeing temperatures drop right now is not due to a storm system. all it is is the fog building up against the coastline. pretty extensive from the north bay to santa cruz. that's going to stay in place for tomorrow. we'll talk more about storm pattern change that's going to help to drop temperatures even more coming up in about 30 seconds. we want to take you outside to the sky camera network. it's chilly. think about where we were just two and three days ago at this hour. 54 in the north bay. in san francisco, still pretty beautiful shot here. we have some fog building.

not the brightest city lights. winds out of the west at 8 miles per hour. but we'll take you to the east bay. see the marine layer. your hdtv going pretty good here. that marine layer up to about 900 feet. pretty strong. and we do think again that's not going anywhere for tomorrow. if you have plans to head to the beach, be prepared for, again, that colder beach weather. we're still accustomed to back across the bay area. high pressure produced at 97 and 98 down into parts of the south bay earlier this week. as we head throughout tomorrow, that starts to fade. here comes the shift in the storm track. it's going to move right across california. it's going to allow this trough of low pressure to move in, essentially helping to drop our temperatures even more as we head throughout saturday and also sunday's forecast. looks like sunday will be the coldest day of the weekend so tomorrow we're going to ease you down just a little bit more. i still think it will be mild to warm here across parts of the south bay. instead of 80s like we had today, you'll go down by about another 5 to 8 degrees. san jose expecting 75.

78 in morgan hill. dhek out san mateo. had 80s just a few days ago. 69 for saturday. 74 palo alto. and san francisco will be lucky if we get out of the 60s. right now we're trending mid to upper 60s from hays valley to the embarcadero. heading up to the north bay, maybe to wine country, napa expecting 70. a little warmer in santa rosa with 74 and a cool breeze in oakland at 69. tri-valley, pleasanton, 75. out to livermore wine country festival which begins tomorrow, we are looking at 75 degrees. speaking of which, we'll take a look at the forecast if you'll head out there nearly the morning. it begins about 10:00. you'll need a light jacket. 66 degrees. low 70s. and then by 4:00 p.m. we're forecasting 75 degrees. and a few other things you may want to know about the festival. it's fantastic out there. a lot of new restaurants, shops are going to be open during this festival. it's going to be happening from 10:00 a.m. to 5:00 p.m. in downtown livermore saturday and

sunday. 300 vendors. you have this kids area as well. if you aren't into tasting the wine do that. also live entertainment and a beer section if you aren't so much into the wine. you also want to check out the bay area booth. you could win a trip to maui. they'll have a live cooking demonstration. so you want to check it out. there's no real other hawaiian tie to the livermore wine country festival other than going to the nbc bay area booth. who would turn down a trip to maui? >> nobody. we'll have to go in disguise and fill out the forms in disguise. >> yes, because employees cannot win. >> i'll wear the mustache. >> we'll see you in livermore this weekend. >> i'll be wearing a blond wig. paying to drive. a new plan for toll roads. >> and we have jimmy, of course. >> hey, guys. kevin spacey is here. lewis black and thank you notes. you have to watch. we're on next.

you could call it growing pains in mountainview. the economy is growing, so is the traffic. they are considering toll roads. basically charging you to use these three exits off 101. san antonio, rengstorff and shoreline. these are heavily congested arteries. the streets lead to google and other high-tech companies. city leaders say they'll first ask the companies to offer incentives to their employees who carpool or use other forms of transportation. the congestion pricing plan will be presented to the city council this december. now something you expect in california but gas prices will be falling and soon. according to analysts, we may see prices dip by 40 to 50 cents a gallon. they say rising oil production has helped stabilize the u.s. inventories. drivers in california are still paying the highest prices in the u.s. right now the average surprise $4.26 a gallon. in the bay area, the highest prices in san francisco at $4.33. san jose at $4.24.

but the cheapest price can be found in oakland at $4.23 a gallon, which is still no bargain. the warriors have checked into their hotel getting ready for tomorrow night's big game seven. also a big night for the sharks -- wishful thinking. for the giants and a's. ♪

he scaled a tall building to get to the chicks. the peregrine falcon chicks that have their identifying leg bands. it requires biologists to rappel from the roof to the ledge where the birds nest every year. those chicks parents were angry, screechingly angry over the scene. the leg bands don't just identify the birds. it also shows how experts determine their sex. the bigger the ankle bone, the more likely the chick is female. the chicks will also start flying in a couple of weeks and then they'll move out and find their own homes. it's a little piece of plastic but may be a big deal at the new levi stadium. fans buzzing about a specially designed hook next to the cup
